第1条総則

本利用規約（以下「本規約」）は、MASATO NAKANO（以下「当方」）が提供する iOS／iPadOS アプリケーション「Zukan」（以下「本アプリ」）の利用に関する条件を定めるものです。

本アプリをダウンロード、インストール、または利用することにより、お客様は本規約に同意したものとみなされます。

第2条本アプリの概要

本アプリは、お客様のコレクション（生き物、植物、御朱印、本、食べ歩きなど）を写真と一緒に記録・整理するための個人向けアプリケーションです。以下の機能を提供します：

テンプレートから図鑑を作成し、項目を自由に定義する機能
アイテムの登録（写真、日付、メモ、タグ、位置情報、カスタム項目）
グリッド・リスト・マップによる一覧表示、検索、絞り込み
iCloud 同期機能（Pro＋機能）
Excel（.xlsx）・CSV・PDF の書き出し機能（Pro 機能）
全データの zip バックアップと読み込み
ゴミ箱（削除から 30 日間の保管）

第3条アカウント不要の利用

本アプリの利用にアカウント登録は不要です。お客様のデータはお客様の端末およびお客様ご自身の iCloud アカウントにのみ保存されます（詳細は「プライバシーポリシー」をご参照ください）。

第4条利用料金

4.1 基本機能（無料）

本アプリの基本機能は無料でご利用いただけます。無料版では、作成できる図鑑の冊数（3 冊まで）およびアイテム 1 件あたりの写真の枚数（1 枚まで）に上限があり、書き出し機能と iCloud 同期機能はご利用いただけません。本アプリに広告は表示されません。

4.2 Pro（買い切り）

Pro は、App 内課金による買い切り（1 回限りのお支払い）として提供され、以下の特典が含まれます：

図鑑の冊数の無制限化
アイテム 1 件あたりの写真の枚数の無制限化
Excel・CSV・PDF の書き出し機能

価格は App Store 内の購入画面に表示されます。サブスクリプション（定期購読）ではないため、解約手続きや自動更新はありません。

4.3 Pro＋（自動更新サブスクリプション）

Pro＋は、年額の自動更新サブスクリプションとして提供され、Pro のすべての特典に加えて iCloud 同期機能をご利用いただけます。

価格および期間は App Store 内の購入画面に表示されます
無料トライアル期間が設定されている場合、トライアル終了の 24 時間前までに解約しない限り、自動的に有料期間へ移行します
期間終了の 24 時間前までに解約しない限り、同一期間・同一価格で自動更新され、お客様の Apple Account に請求されます
解約は iOS の設定（Apple Account ＞サブスクリプション）から行えます。解約後も、支払い済みの期間の終了までは Pro＋の機能をご利用いただけます
Pro を購入済みのお客様には、同期機能のみを追加する割引価格の Pro＋が表示されます

4.4 プランの終了・ダウングレード

Pro＋の期間が終了した場合や、返金等により Pro が無効になった場合でも、お客様のデータは削除されません。ただし、無料版の上限を超える図鑑（4 冊目以降）と写真（2 枚目以降）は閲覧のみ可能となり、追加・編集はできません。また、iCloud 同期は停止し、データは端末内に保持されます。再度 Pro または Pro＋を有効にすると、直ちにすべての機能が復帰します。

4.5 購入の復元

機種変更等の際は、同一の Apple Account でアプリ内の「購入の復元」を行うことで、Pro および Pro＋を再度有効化できます。

4.6 ファミリー共有

Pro および Pro＋は Apple のファミリー共有に対応しています。ファミリー共有の条件は Apple の定めるところに従います。

4.7 返金

App 内課金の返金は Apple が取り扱います。返金をご希望の場合は、Apple のサポートにお問い合わせください。当方が直接返金を行うことはできません。

第5条データの取り扱い

5.1 データの保存

本アプリのデータは、お客様の端末およびお客様ご自身の iCloud（Apple の CloudKit プライベートデータベース）に保存されます。当方がお客様のデータを保有・閲覧することはありません。

5.2 写真の取り扱い

本アプリは、お客様が選択または撮影した写真を縮小・圧縮したコピーのみを保存します。写真アプリから選択した写真の原本は写真アプリに残ります。本アプリ内で撮影した写真は本アプリ内にのみ保存され、写真アプリには保存されません。原本を保管したい場合は、標準のカメラアプリで撮影した写真を選択してご利用ください。

5.3 データの正確性

お客様は、本アプリに入力するデータの正確性について責任を負います。当方は、お客様が入力したデータの正確性について保証いたしません。

5.4 バックアップ

データの保全はお客様ご自身の iCloud 同期およびバックアップ・書き出し機能によって行われます。端末の紛失・故障・iCloud 設定の無効化等によるデータの消失について、当方は一切の責任を負いません。重要なデータは、バックアップ機能を利用して定期的に書き出すことを推奨します。

5.5 iCloud 同期

iCloud 同期のご利用には、Pro＋への加入、iCloud へのサインイン、および十分な iCloud の空き容量が必要です。同期は Apple のサービスを通じて行われるため、Apple 側の障害や通信環境により、同期が遅延または失敗することがあります。複数の端末で同時に同じデータを編集した場合、後から保存された内容が優先されます。

第6条禁止事項

お客様は、本アプリの利用にあたり、以下の行為を行ってはなりません：

本アプリを第三者に貸与、譲渡、再配布すること
本アプリを改変、解析、リバースエンジニアリングすること
本アプリの著作権表示を削除または変更すること
法令または公序良俗に反する目的で本アプリを利用すること
第三者の権利（著作権、肖像権、プライバシー権等）を侵害する写真や情報を記録・書き出し・共有する行為

第7条知的財産権

本アプリおよび本アプリに含まれるコンテンツ（文字、画像、プログラム、テンプレート等）に関する知的財産権は、当方または正当な権利者に帰属します。お客様が本アプリに登録した写真および記録の権利はお客様に帰属し、当方がこれを利用することはありません。

第8条免責事項

当方は、以下について一切の責任を負いません：

本アプリの利用により生じた直接的または間接的な損害
本アプリの動作不良、エラー、バグ等による損害
端末の故障・紛失、iCloud の障害等によるデータの消失、破損による損害
書き出したファイルやバックアップを第三者に共有したことにより生じた損害
マップに表示される位置情報や地名の正確性

本アプリは個人の記録を補助するツールです。生き物や植物の同定、御朱印や商品の価値評価など、記録内容に基づく判断はお客様ご自身の責任で行ってください。

第9条サービスの変更・終了

当方は、事前の通知なく、本アプリの内容の変更、機能の追加・削除、または提供の終了を行うことができるものとします。提供終了の場合は、可能な限り事前に通知いたします。なお、データはお客様の端末と iCloud に保存されているため、本アプリの提供が終了しても、既存のデータが直ちに失われることはありません。バックアップ機能で書き出した zip ファイルには、写真を含むすべての記録が含まれます。

第10条プライバシー

当方は、お客様の個人情報の取り扱いについて、別途定める「プライバシーポリシー」に従って適切に管理いたします。

第11条規約の変更

当方は、必要に応じて本規約を変更することができます。重要な変更がある場合は、アプリ内または App Store ページで通知いたします。変更後の規約は、本ページに掲載した時点で効力を生じるものとします。

第12条準拠法・管轄裁判所

本規約の解釈および適用は日本法に準拠するものとします。本規約に関する紛争については、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

Article 1: General Provisions

These Terms of Use (the “Terms”) set out the conditions for using the iOS/iPadOS application “Zukan” (the “App”) provided by MASATO NAKANO (“we,” “us,” or “our”).

By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

Article 2: Overview of the App

The App is a personal application for recording and organizing your collections (creatures, plants, temple stamps, books, food, and more) together with photos. It provides the following features:

Creating books from templates and defining your own fields
Recording items (photos, date, notes, tags, location, custom fields)
Grid, list and map views with search and filtering
iCloud sync (Pro+ feature)
Export to Excel (.xlsx), CSV and PDF (Pro feature)
Full zip backup and restore
Trash (deleted data is kept for 30 days)

Article 3: No Account Required

No account registration is required to use the App. Your data is stored only on your device and in your own iCloud account (see the Privacy Policy for details).

Article 4: Fees

4.1 Basic Features (Free)

The basic features of the App are free of charge. The free version limits the number of books you can create (up to 3) and the number of photos per item (up to 1), and does not include export or iCloud sync. The App displays no advertisements.

4.2 Pro (One-Time Purchase)

Pro is offered as a one-time in-app purchase and includes the following:

Unlimited number of books
Unlimited photos per item
Export to Excel, CSV and PDF

The price is shown on the purchase screen in the App Store. Pro is not a subscription; there is no cancellation procedure and no automatic renewal.

4.3 Pro+ (Auto-Renewing Subscription)

Pro+ is offered as a yearly auto-renewing subscription and includes everything in Pro plus iCloud sync.

The price and period are shown on the purchase screen in the App Store.
If a free trial is offered, it converts to a paid period automatically unless you cancel at least 24 hours before the trial ends.
The subscription renews automatically for the same period and price, charged to your Apple Account, unless you cancel at least 24 hours before the end of the current period.
You can cancel in iOS Settings (Apple Account › Subscriptions). After cancelling, Pro+ features remain available until the end of the paid period.
Users who already own Pro are shown a discounted Pro+ that adds only the sync feature.

4.4 Expiry and Downgrade

If your Pro+ period ends, or Pro becomes invalid due to a refund or similar, your data is not deleted. However, books beyond the free limit (the 4th and later) and photos beyond the free limit (the 2nd and later) become view-only and cannot be added to or edited. iCloud sync stops and your data remains on your device. Re-enabling Pro or Pro+ restores all features immediately.

4.5 Restoring Purchases

When you change devices, you can re-enable Pro and Pro+ by using “Restore Purchases” in the App with the same Apple Account.

4.6 Family Sharing

Pro and Pro+ support Apple’s Family Sharing. Family Sharing is subject to Apple’s terms.

4.7 Refunds

Refunds for in-app purchases are handled by Apple. To request a refund, please contact Apple Support. We are unable to issue refunds directly.

Article 5: Handling of Data

5.1 Data Storage

App data is stored on your device and in your own iCloud account (Apple’s CloudKit private database). We never hold or view your data.

5.2 Photos

The App stores only a reduced, compressed copy of each photo you select or take. Originals of photos selected from the Photos app remain in the Photos app. Photos taken within the App are stored only in the App and are not saved to the Photos app. If you want to keep an original, take the photo with the standard Camera app and then select it in the App.

5.3 Accuracy of Data

You are responsible for the accuracy of the data you enter in the App. We make no guarantee as to the accuracy of data entered by you.

5.4 Backups

Preservation of your data relies on your own iCloud sync and the backup and export features. We accept no liability for data loss caused by loss or failure of your device, disabling of iCloud settings, or similar events. We recommend exporting a backup regularly for important data.

5.5 iCloud Sync

iCloud sync requires a Pro+ subscription, being signed in to iCloud, and sufficient iCloud storage. Because sync runs through Apple’s services, it may be delayed or fail due to Apple-side outages or network conditions. If the same data is edited on multiple devices at the same time, the most recently saved version takes precedence.

Article 6: Prohibited Conduct

When using the App, you must not:

Lend, transfer, or redistribute the App to third parties
Modify, analyze, or reverse engineer the App
Remove or alter the App’s copyright notices
Use the App for purposes that violate laws or public order and morals
Record, export, or share photos or information that infringe the rights of third parties (copyright, portrait rights, privacy, etc.)

Article 7: Intellectual Property

All intellectual property rights in the App and its contents (text, images, programs, templates, etc.) belong to us or their rightful owners. The rights to photos and records you enter in the App remain yours, and we will never use them.

Article 8: Disclaimer

We accept no liability for any of the following:

Direct or indirect damages arising from use of the App
Damages caused by malfunctions, errors, or bugs in the App
Loss or corruption of data due to device failure or loss, iCloud outages, or similar events
Damages arising from sharing exported files or backups with third parties
The accuracy of locations or place names shown on the map

The App is a tool to assist personal record-keeping. Any decisions based on your records, such as identifying species or assessing the value of items, are your own responsibility.

Article 9: Changes to or Termination of the Service

We may change the contents of the App, add or remove features, or discontinue the App without prior notice. In the case of discontinuation, we will give advance notice where possible. Because your data is stored on your device and in iCloud, existing data is not immediately lost if the App is discontinued. A zip backup exported from the App contains all of your records, including photos.

Article 10: Privacy

We handle your personal information in accordance with our separately published Privacy Policy.

Article 11: Changes to These Terms

We may revise these Terms as necessary. We will announce significant changes within the App or on the App Store page. Revised Terms take effect when posted on this page.

Article 12: Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over our place of business as the court of first instance.
